Registration

The criteria for registering a brand vary from country to country. Generally, for a trade mark to be enforceable (or in some countries even registrable) it must be capable of distinguishing the goods or services of one company from those of another. It must also be capable of being represented graphically.

Registrations may be obtained for words, logos, labels, slogans, the shape of goods or their packaging, sounds and even smells. However it is more difficult to register a shape, sound or smell since it is more difficult to establish that such a mark has sufficient distinctive character for registration.
